Appellate Law

Good trial lawyers do not always make good appellate lawyers.  Successful appeals require detailed knowledge of appellate rules and procedures, exceptional oral and written advocacy skills and the ability, honed through experience, to recognize arguments with the best chance of success on appeal.

Moscone Emblidge & Sater’s attorneys are accomplished appellate advocates.  Our appellate victories in the last decade include:

Air Transport Ass’n of American v. City and County of San Francisco (2001) 266 F.3d 1064 – Defended San Francisco’s groundbreaking equal benefits law, requiring City contractors to make health benefits available to domestic partners of employees

City of Goleta v. Superior Court (2006) 40 Cal.4th 270 – On behalf of amicus curiae homeowners association, defended the rights of newly incorporated cities to self-determination in land use entitlement decisions.

Marlo v. United Parcel Service (2007) 254 Fed.Appx.568 – Overturned a trial court’s grant of summary judgment against a class of UPS employees who had been denied overtime compensation.
